Azerbaijan requires electronic cigarettes to be labeled with warning information

On July 25, 2023, according to Fed.az, the Azerbaijani government is requiring all electronic cigarettes to be labeled with potential health risks in Azerbaijani language on their packaging to comply with current regulations. This measure is aimed at protecting the rights and health of consumers and ensuring that people have access to necessary information.
The antitrust and consumer market regulatory agency affiliated with the country's economic department (Antiinhisar v?? stehlak Bazar? Na N? Zar? T D? Vl? T Xidm? Ti) has received a complaint about the lack of important information in Azerbaijani language on the packaging of electronic cigarettes.
According to the Consumer Rights Protection Law of Azerbaijan, retailers (producers) must provide consumers with necessary and accurate information related to the characteristics, purchase conditions, use, storage, and safe use of the goods they sell. According to Article 13 (1) of the law, this includes providing consumers with necessary and accurate information on the characteristics of the use of goods, acquisition conditions, methods and rules for the use, storage, and safe use of goods.
According to Article 13 (3) of the law, as well as Article 7.4 of the National Language Law of the Republic of Azerbaijan and Article 5.8 of the Rules on Commerce, Public Food, Family and Other Services of the Republic of Azerbaijan, the interpretation of labels and product names translated from other languages into Azerbaijani must be parallel to other languages.
In addition, according to the Law on the Restriction of the Use of Tobacco Products, all stoves and electronic cigarettes are subject to legal restrictions just like tobacco products. According to Article 14.3.4 of the Tobacco and Tobacco Products Law, all imported tobacco products, including disposable electronic cigarettes, must have warning messages in Azerbaijani on their packaging, informing the public of their harmful effects on health.
