Is Electronic Cigarettes Banned Or Not? Brazil Launched Public Consultation On December 12th This Year

Dec 08, 2023

The Brazilian National Health Supervision Agency will hold public consultations on whether electronic cigarettes are prohibited, and the public will have the opportunity to participate and submit opinions and suggestions. Since 2009, electronic cigarettes have been banned in Brazil, but they are still widely traded domestically. Medical experts and civil society believe that the ban should be maintained, but opponents argue that the ban is invalid and suggest establishing basic regulations for regulation.
According to Brazilian media on Cartacapital on December 6th, relevant social groups in Brazil will have the opportunity to publicly participate in discussions on whether e-cigarettes should be banned domestically. The Brazilian National Health Supervision Agency (Anvisa) announced the schedule of relevant consultations in the Federal Official Gazette.
The Brazilian National Health Supervision Agency stated that public consultation will begin on December 12th and continue until February 9th next year. The public can submit opinions and suggestions through online forms. After the consultation, the institution will release a report on this process.
Since 2009, Brazil has banned the production, sale, import, and promotion of electronic cigarette products. Despite this ban, the sale of electronic cigarettes is still common nationwide.
The Brazilian Medical Association (AMB) and the Brazilian Society of Pulmonary Diseases and tuberculosis (SBPT) and other institutions firmly advocate that the sale of electronic cigarettes should be kept prohibited. Their main reason is that although e-cigarettes do not contain most of the toxic substances in traditional cigarettes, they still contain nicotine, which may cause a new generation of chemical addicts.
But the department opposing the ban has proposed that this measure has no substantive effect. They believe that basic regulations should be established to regulate the electronic cigarette market.
